Ways to own in Whistler
Freehold, strata, rental pool, strata hotel and resident-restricted homes, side by side.
Home › Ways to own in Whistler
Two Whistler homes with the same square footage can come with very different rights: one can be rented to visitors, one must be a full-time residence, one has owner-use limits written into the title. This guide explains the main ownership types in plain language and what to ask about each. It does not rank them, because the right one depends on how you plan to use the home.

| Type | What it is | Ask about |
|---|---|---|
| Freehold house or duplex | You own the land and building. In residential zones, nightly rental is not permitted, for any length of stay (Resort Municipality of Whistler, RMOW). | Zoning, covenants on title (tree preservation is common), hazard permit areas, any worker-only suite. |
| Strata townhome or condo | You own a strata lot and share the common property. Bylaws and rules apply on top of zoning. | Bylaws, minutes, financial statements, depreciation report, the Form B. See strata and rentals. |
| Tourist-accommodation (rental pool) unit | A unit zoned and covenanted for tourist accommodation. Phase 1 and Phase 2 covenants are the most common. | The registered covenant, the owner-use rules, the rental pool contract and the fees. |
| Strata hotel | A property where different owners hold strata lots used to provide hotel-like accommodation (BC definition). | Whether it is registered, how bookings work, what the strata and covenants allow. |
| Fractional or timeshare interest | A share of use of a home or unit, regulated in BC by the development marketing rules where a development has five or more time share interests. | The disclosure statement, the rescission right and the exact rights you are buying. |
| Resident-restricted (WHA) home | A price-controlled home reserved for local workers and retirees who live in it full time. | Whether you qualify, the waitlist and the maximum resale price. Generally not available to second-home buyers. |
Freehold houses and duplexes
The RMOW’s only statement found on these is about use: tourist (nightly) accommodation is not permitted in residential zones, regardless of how long the guests stay. A private home may also include a suite that only a Whistler worker may rent. This guide could not find RMOW details on suite size or eligibility, so ask the municipality about any specific property.
Strata townhomes and condos
The Province explains that a strata corporation is created when a developer files a strata plan at the Land Title Office. Owners hold their strata lots and jointly own the common property. A bare land strata has houses on individual strata lots. Stratas can be freehold or leasehold, and the Province lists duplexes, townhouses and “fractional vacation properties” among residential stratas. See the strata and rentals guide for fees, documents and rental rules.
Tourist-accommodation and rental-pool units
The RMOW defines tourist accommodation as “the business of marketing, managing, and providing paid accommodation to visitors.” A property’s zoning must list tourist accommodation or temporary accommodation as a permitted use, and the RMOW has an online map layer called “Zoned for Nightly Rentals.” Two covenants are the most common, according to the RMOW:
- Phase 1 is described as less restrictive. When the owner is not using the unit, it usually must be available to the public through a rental pool. Where no single pool is required, owners can often choose their own booking and management or self-manage. The RMOW page gives no number of owner-use days, so read the registered covenant.
- Phase 2 requires every unit to be available for commercial rental, except for owner use of 28 days in summer and 28 days in winter, in a single integrated rental pool chosen by the strata owners.
- The RMOW says it does not typically modify rental pool covenants. For properties with Phase 2 covenants, a hotel needs only one business licence.
- Employee housing units cannot be marketed or rented to tourists for any length of time.
Strata hotels
The Province defines a strata-titled hotel or motel as “a property in which accommodation is provided in a manner like that of a hotel or motel,” with several owners each holding a separate strata lot. Under the Province’s guidance (December 2025), certain strata hotels are exempt from the principal residence requirement, and a strata hotel that runs a website where units are listed and booked must register as a strata hotel platform. The RMOW says strata hotels must register with the provincial registry. Whether a particular building counts as a strata hotel is a fact to confirm, not assume.
Fractional and timeshare ownership
BCFSA says the Real Estate Development Marketing Act applies to developments with five or more time share interests. The developer must give the filed disclosure statement before a sale, buyers have a seven-day rescission right, and deposits are generally held in trust in BC. This guide found no official Whistler source describing whether fractional or timeshare ownership is used in Whistler today, so this guide does not describe it here. If you are offered one, ask for the disclosure statement and have a lawyer review it.
Resident-restricted housing (Whistler Housing Authority)
The RMOW says the Whistler Housing Authority (WHA) offers price-controlled rental and ownership homes for workers and retirees, with 988 ownership homes and 327 rental homes, and that the RMOW owns the WHA, which operates independently. Ownership homes include condos, townhouses and single-family homes. From the WHA’s own guidelines (the files are undated, so check whistlerhousing.ca for current versions):
- Applicants must be 19 or older, Canadian citizens or permanent residents, and a Qualified Employee or Qualified Retiree.
- A Qualified Employee works for a Qualified Whistler Business an average of at least 30 hours a week, annualized. A Qualified Retiree is 55 or older, was a Qualified Employee for at least 10 of the past 12 years, and has since lived in Whistler, Squamish or Pemberton.
- Offers go to buyers in waitlist order, by application date. The owner must live in the home continuously as a primary residence and sign an annual occupancy declaration.
- Each home has a Maximum Resale Price set by its registered Housing Agreement. For more than 80% of price-restricted inventory, the WHA’s Owners Guide says the formula is the purchase price plus the change in the Core CPI, plus approved capital improvements; older projects may use other formulas.
- Nightly rentals, short-term rentals and home exchanges are not permitted. Owners may house Whistler employees at a confirmed Maximum Rental Rate.
Leasehold
The Province describes a strata leasehold as a term lease, often 99 years, where the landlord keeps the land and, when the lease ends, land and building revert to the landlord. This guide found no RMOW, WHA or other official source describing leasehold residential homes in Whistler. Always confirm tenure on the title search.

Quick answers
What is a strata corporation?
It is created when a developer files a strata plan at the Land Title Office. Owners hold their own strata lots and jointly own the common property, and must follow the Strata Property Act and the strata’s bylaws and rules.
What is the difference between Phase 1 and Phase 2 rental pool covenants in Whistler?
The Resort Municipality of Whistler describes Phase 1 as less restrictive and Phase 2 as requiring every unit to be in a single integrated rental pool, with owner use limited to 28 days in summer and 28 days in winter. Which applies depends on the covenant registered on title.
What is a strata hotel under BC rules?
The Province describes it as a property where different owners hold different strata lots used to provide accommodation in a manner like a hotel or motel. Strata hotels that take bookings through their own website must register with the provincial short-term rental registry.
Can anyone buy a Whistler Housing Authority home?
No. Buyers must qualify through the WHA ownership waitlist as a Qualified Employee or Qualified Retiree, and generally cannot own other real estate. The owner must live in the home as a primary residence, and nightly rentals are not permitted.
How is the resale price of a WHA home set?
Each home has a Maximum Resale Price set by the formula in its registered Housing Agreement. For most of the price-restricted inventory the formula uses the change in the Core CPI, plus approved capital improvements.
Does BC regulate timeshare sales?
BCFSA says the Real Estate Development Marketing Act covers developments of five or more time share interests, with a filed disclosure statement and a seven-day rescission right. Confirm the details with BCFSA or a lawyer.
